Refund and Returns Policy

At EMARKZ LLC, we aim to provide professional website development and digital solutions that meet the agreed project requirements. Because our services involve customized design, development time, technical work, and project-specific resources, our refund policy is designed to clearly explain when refunds may or may not be available.

By purchasing our services, you acknowledge and agree to the terms outlined below.

1. About EMARKZ LLC

EMARKZ LLC provides digital development services, including:

  • Custom Website Development

  • E-Commerce Website Development

  • Responsive Web Design & Development

  • Web Application Development

  • Website Maintenance & Support

  • Search Engine Optimization

  • Related website and digital development services

Company: EMARKZ LLC

2. Nature of Our Services

Our services are primarily custom digital services, rather than physical products.

Depending on the project, we may spend significant time on:

  • Project planning

  • Requirements analysis

  • Website architecture

  • Design

  • Development

  • Coding

  • Content implementation

  • Responsive optimization

  • Testing

  • Integrations

  • Configuration

  • Revisions

  • Deployment

Because these services are customized for each Client, they cannot generally be returned in the same way as a physical product.

3. One-Time Payment Model

EMARKZ generally provides development packages through a one-time payment model.

This means:

  • Our development packages are not automatically recurring subscriptions.

  • Clients are charged according to the agreed package or project terms.

  • There is no automatic monthly development subscription unless separately agreed in writing.

  • Third-party recurring charges are separate from EMARKZ’s development fees.

Third-party services such as hosting, domains, premium software, plugins, APIs, payment processors, or external platforms may have their own refund policies and fees.

4. General Refund Policy

Because our services are customized and development work may begin after payment, payments are generally non-refundable once substantial work has started, except where a refund is expressly required by applicable law or agreed by EMARKZ in writing.

We encourage Clients to review the project scope, package features, pricing, requirements, and terms carefully before making payment.

5. Before Project Development Begins

If you request cancellation before meaningful project work has started, EMARKZ may consider a refund depending on the circumstances.

Any refund may take into account:

  • Administrative work already completed

  • Project planning

  • Requirements analysis

  • Payment processing fees

  • Third-party costs

  • Design preparation

  • Other non-recoverable expenses

Refund eligibility will be determined on a case-by-case basis unless a specific written agreement states otherwise.

6. After Development Has Started

Once substantial development work has started, payments are generally non-refundable.

This is because EMARKZ may already have invested time and resources into:

  • Planning

  • Design

  • Development

  • Coding

  • Testing

  • Configuration

  • Project management

  • Technical research

  • Content implementation

If a Client decides to cancel after substantial work has begun, the amount already paid may not be refundable.

7. Completed Projects

Once the agreed project has been completed and delivered according to the approved scope, payments are generally non-refundable.

Completion may include:

  • Final website delivery

  • Application delivery

  • Deployment

  • Final approval

  • Handover

  • Delivery of agreed files

  • Completion of the agreed development scope

The Client is responsible for reviewing the project before providing final approval.

8. Client-Initiated Cancellation

A Client may request cancellation at any time by contacting:

hi@emarkz.com

However, cancellation does not automatically create a right to a refund.

The refund decision may depend on:

  • Project status

  • Amount of work completed

  • Amount paid

  • Third-party costs

  • Project scope

  • Written agreements

  • Applicable law

9. Changes in Client Requirements

A Client may change their requirements during development.

However, significant changes may require additional work.

Examples include:

  • Changing the entire design

  • Adding new pages

  • Adding new functionality

  • Changing the website structure

  • Adding new integrations

  • Replacing an approved design

  • Expanding the project scope

Such changes do not automatically qualify the Client for a refund.

Instead, EMARKZ may provide an additional quotation or revised project scope.

10. Design Approval

Clients may be asked to review and approve designs or project components.

Once a design or major component has been approved, requests for substantial redesigns may be treated as additional work.

Clients are encouraged to carefully review:

  • Layout

  • Colors

  • Typography

  • Content

  • Images

  • Navigation

  • Functionality

  • Overall appearance

before providing approval.

11. Revision Policy

Where revisions are included in a package, they are subject to the limits and conditions stated in the applicable project agreement.

A revision generally means modifying an existing approved element.

A revision does not necessarily include a complete redesign or major change in project direction.

Requests outside the agreed revision allowance may incur additional charges.

12. Dissatisfaction With Design

A Client’s subjective dissatisfaction with a completed design does not automatically qualify for a refund.

EMARKZ will make reasonable efforts to address legitimate concerns that fall within the agreed project scope.

If the Client requests changes that are outside the original scope, additional fees may apply.

13. Failure to Provide Client Materials

Clients are responsible for providing information and materials required to complete their project.

This may include:

  • Content

  • Images

  • Logos

  • Product information

  • Credentials

  • Business information

  • Technical requirements

  • Approvals

  • Feedback

If a project is delayed because the Client fails to provide necessary information, this does not automatically create a refund entitlement.

14. Client Communication Delays

Timely communication is important for project completion.

If a Client does not respond to requests for information, feedback, approval, or clarification, the project timeline may be extended.

Such delays do not automatically qualify the Client for a refund.

15. Project Cancellation Due to Client Inactivity

If a Client becomes unresponsive for an extended period, EMARKZ may attempt to contact the Client using the available communication information.

If the Client remains unresponsive, EMARKZ may suspend or close the project.

Any refund consideration will depend on:

  • Work already completed

  • Amount paid

  • Project status

  • Applicable third-party costs

  • Written project terms

16. Technical Issues

If a delivered website or application contains a technical issue that falls within the agreed project scope, the Client should contact EMARKZ so we can investigate.

Where the issue is caused by our development work, we may attempt to correct it within the applicable project support or warranty period, if one exists.

A technical issue does not automatically create a right to a refund.

17. Third-Party Services

Our projects may depend on third-party services such as:

  • Hosting providers

  • Domain registrars

  • Payment processors

  • Plugins

  • APIs

  • Software platforms

  • Email providers

  • Analytics tools

EMARKZ does not control third-party services.

If a third-party service experiences:

  • Downtime

  • Pricing changes

  • Service termination

  • Compatibility problems

  • Policy changes

  • Account suspension

  • Technical failures

these circumstances generally do not qualify for a refund of EMARKZ development fees.

Third-party fees are subject to the relevant provider’s refund policy.

18. Domain and Hosting Fees

If domain registration or hosting is purchased separately or through a third party, those fees may be non-refundable depending on the provider’s terms.

EMARKZ is not responsible for refunds governed by third-party domain or hosting providers.

19. Payment Processing Fees

Where a refund is approved, non-refundable payment processing or transaction fees may be deducted where permitted by applicable law and the relevant payment provider’s terms.

The amount refunded will depend on the circumstances of the refund.

20. Duplicate Payments

If you accidentally make a duplicate payment for the same invoice or service, please contact us promptly.

After verifying the duplicate transaction, EMARKZ may issue an appropriate refund, subject to payment processing considerations.

21. Unauthorized Transactions

If you believe a transaction was made without your authorization, contact us immediately at:

hi@emarkz.com

We may request information necessary to investigate the transaction.

We may also work with the relevant payment provider to investigate disputed transactions.

22. Fraudulent or Abusive Transactions

EMARKZ reserves the right to investigate transactions suspected of fraud, abuse, or unauthorized activity.

Where appropriate, we may:

  • Suspend services

  • Delay delivery

  • Cancel an order

  • Refuse a refund

  • Cooperate with payment providers

  • Take appropriate legal action

Nothing in this section limits rights available under applicable law.

23. Refunds for Legal Rights

Nothing in this policy is intended to exclude or restrict any refund, cancellation, warranty, or consumer rights that cannot legally be excluded or restricted under applicable law.

Where applicable law provides mandatory refund rights, those rights will apply.

24. Refund Request Process

To request consideration for a refund, contact:

Email: hi@emarkz.com

Your request should include:

  • Full name

  • Business name, if applicable

  • Email used for the purchase

  • Invoice or transaction information

  • Service purchased

  • Date of payment

  • Reason for the request

  • Relevant project information

Providing complete information helps us review the request efficiently.

25. Refund Review

After receiving a refund request, we may review:

  • The project agreement

  • Payment records

  • Project status

  • Work completed

  • Deliverables provided

  • Client communications

  • Scope of services

  • Third-party costs

  • Applicable legal requirements

We may contact you for additional information before making a decision.

26. Refund Approval

If a refund is approved, we will generally process it using the original payment method where reasonably possible.

The time required for the funds to appear in your account may depend on the payment provider or financial institution.

EMARKZ does not control the processing time of third-party financial institutions.

27. Partial Refunds

In certain circumstances, EMARKZ may determine that a partial refund is appropriate.

A partial refund may consider:

  • Work already completed

  • Deliverables already provided

  • Project planning

  • Development time

  • Third-party costs

  • Administrative expenses

  • Other applicable project costs

Partial refunds are discretionary unless required by applicable law or a written agreement.

28. Non-Refundable Circumstances

Subject to applicable law, refunds generally will not be available solely because:

  • The Client changes their mind after development begins.

  • The Client no longer needs the website.

  • The Client changes business direction.

  • The Client chooses another developer.

  • The Client does not provide required content.

  • The Client delays communication.

  • The Client changes project requirements.

  • The Client dislikes an approved design without identifying a scope issue.

  • The Client’s business circumstances change.

  • The Client expected results not included in the agreed scope.

  • Third-party services change or become unavailable.

  • The Client does not achieve expected sales or traffic.

29. Business Results and Refunds

EMARKZ provides development services, not guaranteed business outcomes.

We do not guarantee:

  • Specific revenue

  • Specific sales

  • Specific website traffic

  • Specific search rankings

  • Specific conversion rates

  • Specific number of customers

  • Specific return on investment

Failure to achieve a particular business result does not automatically qualify for a refund.

30. SEO Service Refunds

If SEO is purchased as part of a service package, SEO results depend on many external factors.

We do not guarantee specific:

  • Search rankings

  • Traffic levels

  • Leads

  • Sales

  • Search engine visibility

SEO payments are subject to the agreed service terms and are generally non-refundable once the agreed work has begun, except where applicable law requires otherwise.

31. Website Maintenance and Support

Maintenance and support services are subject to their individual scope.

Where maintenance work has already been performed, payments for completed work are generally non-refundable.

Unused services may be evaluated according to the applicable agreement.

32. E-Commerce Projects

E-commerce projects may involve substantial configuration and customization.

Once development, product setup, checkout configuration, payment integration, or other substantial work has begun, payments are generally non-refundable.

Third-party payment providers may have separate refund requirements for transaction-related services.

33. Web Application Projects

Web application development often requires substantial planning, architecture, programming, testing, and configuration.

Because projects may involve significant customized development, payments are generally non-refundable after substantial development has begun, except where otherwise required by applicable law or agreed in writing.

34. Source Code and Project Files

Where applicable, ownership or delivery of source code and project files is subject to the project’s payment and intellectual property terms.

A refund or cancellation may affect the delivery of unfinished project materials.

35. Termination by EMARKZ

If EMARKZ terminates a project for reasons unrelated to Client misconduct or breach, we may review the project status and determine an appropriate refund or credit for undelivered work, subject to applicable law and the project agreement.

If termination occurs because of Client misconduct, non-payment, unlawful requests, or material breach, refund eligibility may be limited.

36. Refunds and Project Ownership

A refund may affect rights to unfinished or delivered project materials.

Unless otherwise agreed in writing, the Client should not assume that receiving a refund automatically transfers ownership of unfinished development work, source code, designs, or other project materials.

Intellectual property rights remain governed by the applicable Terms and Conditions and project agreement.

37. No Physical Product Returns

EMARKZ primarily provides digital services.

Therefore, there are generally no physical products to return.

Digital deliverables, designs, code, websites, applications, and development services cannot be “returned” in the same manner as physical merchandise.

38. Policy Changes

We may update this Refund and Return Policy from time to time.

Changes may reflect:

  • Changes in our services

  • Changes in payment processes

  • Changes in applicable laws

  • Changes in business practices

  • Changes in project structures

The updated policy will include a revised “Last Updated” date.

39. Relationship With Other Policies

This Refund and Return Policy should be read together with:

  • Our Terms and Conditions

  • Our Privacy Policy

  • Applicable project agreements

  • Quotes and proposals

  • Invoices

  • Other written service agreements

If there is a conflict between this policy and a specific written project agreement, the project agreement may control to the extent stated in that agreement.
